Using RigCheck responsibly
These terms govern individual use of RigCheck. A separate Department Agreement or order form may govern the department workspace and controls if it conflicts with these User Terms.

Agreement and eligibility
By creating an account, accepting these terms, or using RigCheck, you agree to these User Terms and acknowledge the Privacy Notice. You must be legally able to agree and authorized by your organization to use its workspace. If you do not agree, do not use the service.
Service purpose
RigCheck provides department-configured apparatus inspections, inventory and expiration tracking, personnel access, reports, and related administrative tools. It is a recordkeeping aid, not an emergency, dispatch, clinical, maintenance-certification, or regulatory-compliance system.
Operational responsibility
You and your department remain responsible for equipment standards, inspection frequency, maintenance, staffing, review, legal retention, regulatory compliance, and decisions about whether an apparatus is ready for service. Do not rely on RigCheck as the only means of detecting hazards or meeting a mandatory inspection duty.
Accounts and access
Provide accurate information, protect credentials, use your own account, and promptly report suspected unauthorized access. Department owners and administrators grant and remove workspace access. An invitation grants access only after the exact invited email is verified. Department ownership may be transferred only through the in-product nomination and acceptance process. You may not access another department’s information without authorization.
Department information and prohibited patient data
Your department retains responsibility for information its users submit and authorizes its processing to operate, secure, and support RigCheck. You may submit only information you are authorized to provide. Do not enter patient names, patient care information, protected health information, dispatch narratives, or clinical records. RigCheck is not offered as a HIPAA patient-record system, and no business associate agreement applies unless separately signed.
Records and legal holds
Archiving a report does not destroy it. Standard permanent disposal is available only to a department owner under recorded retention settings after the configured period and while no legal hold is active. The verified RigCheck app owner, while also serving as that department’s owner, may explicitly use an audited technical override to remove a false test report before the retention period. The override never bypasses a legal hold and does not create legal authority to delete a record. These controls assist the department but do not decide what law applies. Users must comply with applicable public-records, open-records, litigation-hold, employment, and retention duties.
Acceptable use
You may not share accounts; misuse invitations; upload malicious or unlawful content; probe, bypass, or interfere with security; scrape or overload the service; infringe rights; misrepresent records; use RigCheck to make unauthorized surveillance or employment decisions; or resell access without written permission.
Intellectual property and feedback
RigCheck and its software, design, branding, and documentation are protected by applicable intellectual-property laws. These terms grant only a limited, nonexclusive, nontransferable right to use the service for authorized department operations. Departments retain their rights in submitted information. Feedback may be used to improve RigCheck without an obligation to compensate the sender.
Subscriptions and third-party services
If billing is enabled, displayed fees, billing interval, renewal terms, and cancellation controls apply at checkout or in the department’s order form. Stripe processes payments. Cloudflare, Supabase, Resend, and other providers support service operation under their own terms. RigCheck is not responsible for services a user independently connects or visits.
Availability, suspension, and termination
RigCheck may change features to improve security, reliability, legality, or usability. Access may be limited to address nonpayment, unlawful use, threats, or material breach. Reasonable efforts will be made to preserve access to department exports when practical, but uninterrupted or error-free service is not promised.
Disclaimers and limits
To the extent permitted by law, RigCheck is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. RigCheck is not liable for emergency-response decisions, equipment readiness decisions, or a department’s legal compliance. Any liability allocation, service commitment, indemnity, or negotiated remedy in a signed Department Agreement or order form controls for that department. Some jurisdictions do not allow particular exclusions, so these limits apply only to the extent permitted.
Law, changes, and contact
Unless a signed department agreement states otherwise or mandatory public-entity law requires another result, Illinois law governs without regard to conflict-of-law rules. These terms do not waive sovereign immunity, venue rules, or other restrictions that cannot lawfully be waived. Material changes will use a new version and may require renewed acceptance.
